Privacy Policy

PRIVACY POLICY

This Privacy Policy describes how Briteminds Learning Center, Inc. (“BriteMinds,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with the websites located at briteminds.com and britemindsfamily.com, and any related services, content, assessments, quizzes, reports, tutoring services, communications, chatbot features, payment features, scheduling features, and other online features (collectively, the “Services”).

By using the Services, you acknowledge that you have read and understand this Privacy Policy.

1. Parent-Controlled Service; Authorized Teen Participants; Children Under 13

The Services are intended primarily for use by parents, legal guardians, and other adults. A minor who is at least 13 years old may participate in certain Services only as an authorized minor participant with the consent of a parent or legal guardian. The parent or legal guardian must create, authorize, or approve the account or use of the Services, consent to the use and disclosure of the minor’s personal information as described in this Privacy Policy, and remain responsible for the minor’s use of the Services.

If you are at least 13 years of age but under the age of majority, you may use the Service only with parent or legal guardian consent. BriteMinds may require parent or legal guardian confirmation before allowing you to create an account, complete assessments or quizzes, use interactive tools, communicate with BriteMinds, or submit personal information.

Children under 13 years of age may not create accounts, use the Services directly, make purchases, complete assessments or quizzes, use chatbot or interactive features, or submit personal information through the website. Parents and legal guardians may provide information about children under 13 only for parent-facing Services, reports, tutoring intake, or educational support. If we learn we have collected personal information directly from a child under 13 without appropriate parental involvement, we will take reasonable steps to delete that information or obtain appropriate consent where required.

2. Information We Collect

A. Information You Provide to Us

We may collect information that you provide directly, including:

  • parent or guardian name;
  • email address;
  • phone number;
  • mailing address;
  • account login information;
  • payment and billing information;
  • information submitted through forms, questionnaires, assessments, quizzes, surveys, or intake materials;
  • information submitted through the chatbot;
  • messages, emails, and other communications with us;
  • tutoring-related information;
  • scheduling information;
  • feedback, testimonials, or customer support inquiries;
  • any other information you choose to provide.

B. Information About a Child Provided by a Parent or Guardian

If a parent, legal guardian, or an authorized minor participant who is at least 13 years old uses the Services with parent or legal guardian consent, we may collect the following information:

  • first name, nickname, initials, or other identifier selected by the parent or guardian, or authorized minor participant;
  • age, birth month/year, or grade level;
  • educational needs, tutoring needs, learning history, learning habits, or study habits;
  • screen-time habits, favorite online games, attention patterns, behavior-related observations, socialization status, or family routines;
  • information submitted in connection with an assessment, quiz, questionnaire, report, tutoring intake form, or consultation;
  • parent-provided comments or concerns relating to the child’s education, habits, or well-being.

A minor’s full legal name is not required to complete the assessment or quiz. Parents and guardians may use a first name, nickname, initials, or another identifier. We do not verify whether the name or identifier provided for a child or minor participant is that person’s legal name.

We collect child-related information only from parents, legal guardians, or authorized adults. Children are not permitted to submit this information directly without prior parental consent.

We do not intentionally request medical records, psychotherapy notes, clinical diagnoses, or emergency information through the Service. You should not submit unnecessary sensitive information unless it is requested by BriteMinds and necessary for the Services.

C. Assessment, Quiz, and Report Information

If you complete a paid or free assessment, questionnaire, quiz, or similar feature, we may collect your responses and use them to generate scores, risk levels, written reports, recommendations, or other educational content.

Quiz questions are generally multiple-choice questions. Free-text fields, if any, are intended for prerequisite or intake information, such as parent or guardian contact information and limited child-related information provided by the parent or guardian.

Assessment scores, risk levels, report categories, and recommendations are calculated based on information self-reported by the parent or guardian. We do not independently verify the accuracy or completeness of the information submitted.

Reports and recommendations are intended for educational and informational purposes only. They are not medical, psychological, therapeutic, diagnostic, or clinical evaluations. Recommendations may include educational strategies, parent-involvement suggestions, screen-time management suggestions, resources, or, in higher-risk situations, a suggestion that the parent or guardian consider consulting appropriate outside professionals or resources.

D. Chatbot and Online Interaction Data

If you use our chatbot, virtual assistant, or other automated communication tool, we may collect:

  • your chatbot messages;
  • information you submit through the chatbot;
  • date and time of interactions;
  • pages visited before, during, or after the chatbot interaction;
  • device and browser information;
  • IP address;
  • session information;
  • chatbot interaction history and usage information.

The chatbot is AI-assisted and may also involve human review or human follow-up. The chatbot is intended for use by adults only. Please do not submit sensitive personal information, medical information, psychological information, emergency information, financial account information, Social Security numbers, detailed child information, or other unnecessary confidential information through the chatbot.

Chatbot conversations may be recorded and stored. Chatbot transcripts may be provided to our chatbot service provider and technical service providers so they can operate, maintain, secure, and support the chatbot. We do not intentionally link chatbot transcripts to a parent’s assessment responses, report, or customer profile unless necessary to respond to a specific request, provide support, comply with law, or as otherwise disclosed.

We do not authorize chatbot vendors to use chatbot transcripts or related data for advertising, profiling, resale, unrelated AI training, or independent product development, except as expressly disclosed in this Privacy Policy or permitted by applicable law.

E. Automatically Collected Information

When you use the Services, we and our service providers may automatically collect certain information, including:

  • IP address;
  • device type;
  • browser type;
  • operating system;
  • referring URLs;
  • pages viewed;
  • links clicked;
  • time spent on pages;
  • date and time of visits;
  • approximate location based on IP address;
  • cookie identifiers;
  • analytics information;
  • other usage and technical information.

Our analytics and website tools are not intended to collect quiz answers, assessment results, risk levels, written report contents, or chatbot message contents for advertising or retargeting purposes.

F. Payment Information

If you make a purchase, payment information may be collected and processed by our third-party payment processor, such as Stripe. We may receive limited payment-related information, such as your name, billing contact information, transaction amount, payment status, and transaction history.

We do not intend to store full credit card numbers on our own systems.

3. How We Use Information

We may use personal information to:

  • provide, operate, and improve the Services;
  • create and manage accounts;
  • process purchases, payments, refunds, and transactions;
  • schedule tutoring sessions, consultations, or other services;
  • provide tutoring, educational support, reports, recommendations, and related services;
  • generate assessment results, scores, risk levels, report categories, and written reports;
  • send or resend assessment reports at the request of the parent or guardian;
  • respond to inquiries and provide customer support;
  • operate, support, secure, and troubleshoot chatbot features and other interactive tools;
  • communicate with you about your account, purchases, appointments, assessments, reports, and Services;
  • send administrative, transactional, and service-related messages;
  • send marketing communications where permitted by law and consistent with your preferences;
  • provide follow-up communications where you request continued services, consultations, tutoring, or related support;
  • personalize content and user experience;
  • analyze website usage and improve functionality;
  • maintain security and prevent fraud, misuse, or unauthorized access;
  • debug, troubleshoot, and repair technical issues;
  • comply with legal obligations;
  • enforce our Terms of Service and other policies;
  • protect our rights, users, and business.

BriteMinds may use automated, rules-based, algorithmic, or AI-assisted tools to help generate assessment results, risk levels, recommendations, or written reports. These tools rely on information submitted by users and may be incomplete, inaccurate, or non-individualized.

We do not use quiz answers, assessment results, risk levels, written reports, report categories, or chatbot transcripts for retargeting, advertising optimization, or lead scoring unless we separately disclose that practice and obtain any legally required consent or opt-out authorization.

4. How We Disclose Information

We may disclose personal information as described below.

A. Service Providers and Contractors

We may disclose information to vendors, service providers, contractors, and technical providers that help us operate our business and provide the Services, including providers of:

  • website hosting and cloud infrastructure, including Cloudways or successor hosting providers;
  • website development, WordPress, plugin, and technical support services;
  • quiz, assessment, and report-generation tools;
  • AI-assisted report generation, including Claude/Anthropic or similar AI service providers;
  • payment processing, including Stripe;
  • scheduling tools, including BookingPress;
  • email and communications tools, including Constant Contact;
  • chatbot and automated communication tools;
  • analytics tools, including Google Analytics and Google Tag Manager;
  • security, backup, troubleshooting, and fraud prevention tools;
  • tutoring operations;
  • professional services, including legal, accounting, compliance, and consulting services.

These service providers may process information on our behalf and are expected to use the information only as necessary to provide services to us or as otherwise permitted by contract and applicable law. Our vendor contracts should prohibit vendors from using quiz responses, written reports, child-related information, chatbot transcripts, or parent contact information for advertising, profiling, resale, unrelated AI training, or the vendor’s independent product development.

B. Tutoring and Educational Support

We may disclose relevant information to tutors, instructors, contractors, or personnel who need the information to provide tutoring, educational support, assessment-related services, consultation services, report-related support, or customer support.

C. Parent-Directed Sharing

At your request, or with your authorization, we may share assessment reports or tutoring-related information with teachers, school administrators, tutors, physicians, therapists, counselors, or other professionals involved in your child’s education or care.

D. Legal and Safety Reasons

We may disclose information if we believe it is reasonably necessary to:

  • comply with law, legal process, or governmental requests;
  • enforce our Terms of Service or other policies;
  • investigate fraud, security issues, misuse, or unauthorized activity;
  • protect the rights, property, safety, or security of BriteMinds, users, children, or others;
  • respond to emergencies or potential harm.

E. Business Transactions

We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction.

F. With Your Consent

We may disclose information with your consent or at your direction.

5. Cookies, Analytics, and Similar Technologies

We and our service providers may use cookies, pixels, local storage, analytics tools, tags, scripts, plugins, and similar technologies to operate the website, remember preferences, analyze usage, improve performance, support communications, process forms, support scheduling and payment functionality, and maintain security.

The tools we use or may use include Google Analytics, Google Tag Manager, quiz signup tools, BookingPress, Constant Contact widgets, Divi contact forms, Stripe payment tools, WordPress plugins, and similar website technologies.

Analytics tools may be active on quiz pages and chatbot pages to measure website usage and interactions. Analytics and advertising tools are not intended to collect quiz answers, assessment scores, risk levels, written report contents, report categories, or chatbot message contents.

We do not use session replay, screen recording, heatmapping, mouse-tracking, or keystroke-logging tools. We do not intentionally transmit quiz answers, assessment scores, risk levels, written reports, report categories, or chatbot transcripts to Google, Meta, TikTok, LinkedIn, or similar advertising or analytics platforms for retargeting or advertising optimization.

You may be able to adjust cookie settings through your browser or through our cookie banner or consent-management tool, where available. Disabling cookies may affect website functionality.

6. Cookie Banner, Consent Preferences, and Opt-Out Signals

We may provide a cookie banner or consent-management tool that allows users to accept, reject, or manage non-essential cookies and similar technologies.

Where we provide a cookie banner or consent-management tool, non-essential cookies and tags should be blocked or managed in accordance with the choices presented to the user and the technical settings of the tool. Disabling cookies may affect website functionality.

Currently, BriteMinds is not subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act. Accordingly, BriteMinds does not currently provide a CCPA-specific “Do Not Sell or Share My Personal Information” link or process Global Privacy Control signals as statutory CCPA opt-out requests. If BriteMinds becomes subject to the CCPA or another law requiring such opt-out mechanisms, or if our use of cookies, pixels, analytics, or advertising tools changes in a way that requires additional opt-out controls, we will update this Privacy Policy and provide any required notices and choices.

7. Chatbot Data and Third-Party Tools

Our chatbot may be operated by us or by a third-party service provider. Chatbot interactions may be collected, stored, reviewed, processed, and used to provide support, respond to inquiries, maintain security, troubleshoot issues, improve the Services, and comply with legal obligations.

The chatbot is automated, AI-assisted, and may be reviewed or supplemented by humans. It may generate incomplete, inaccurate, outdated, or non-individualized responses. It does not provide medical, psychological, therapeutic, diagnostic, tutoring, legal, or other professional advice.

Before using the chatbot, users should be presented with a notice disclosing that the chatbot is AI-assisted, that chats may be recorded or stored, and that responses may be reviewed or handled by humans. You should not submit confidential, sensitive, medical, psychological, emergency, detailed child-related, or unnecessary personal information through the chatbot.

8. No Medical or Psychological Services

The Services are intended for educational and informational purposes only. BriteMinds does not provide medical, psychological, psychiatric, therapeutic, diagnostic, or clinical services.

Information collected through assessments, reports, tutoring intake forms, chatbot interactions, or other Services is not used to diagnose, treat, cure, prevent, or evaluate any medical, psychological, developmental, behavioral, or mental health condition.

If you have concerns about your child’s health, mental health, safety, development, behavior, or well-being, you should consult a qualified professional. If there is an emergency or immediate risk of harm, call 911 or seek emergency assistance.

9. Children and Teen Privacy

Children under 13. Children under 13 may not use the Services directly or submit personal information through the Website. Parents and legal guardians may provide information about children under 13 for parent-facing Services, reports, tutoring intake, or educational support. If we learn we have collected personal information directly from a child under 13 without appropriate parental involvement, we will take reasonable steps to delete it or obtain appropriate consent where required.

Teens 13 to 17. Authorized minor participants who are between 13 and 17 years old may use certain Services only with parent or legal guardian consent. We may collect information from or about those teen users to provide tutoring, assessments, reports, scheduling, communications, and support.

Parent-provided information. Parents and legal guardians may provide information about children or teens, including name or nickname, age, grade, learning history, behavioral observations, screen-time habits, socialization status, and other information needed to provide the Services.

Parent rights. Parents and legal guardians may contact us to review, correct, delete or restrict information associated with a minor, or to revoke consent for a teen’s continued participation, subject to legal, security, billing, recordkeeping, and service-related requirements.

10. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and operate our business.

We may retain parent account information, child or teen profile information, assessment responses, score information, risk-level information, report categories, and written reports, tutoring records, payment records, communications, chatbot transcripts, and analytic data for different periods depending upon the purpose for which the information was collected. Parents or legal guardians may request deletion or restriction of minor-related information by contacting us, unless retention is reasonably necessary for legal, security, fraud-prevention, payment, accounting, dispute-resolution, or compliance purposes.

Chatbot transcripts, analytics logs, cookie-consent records, payment records, scheduling records, email records, and customer-service records may be retained for different periods depending on the nature of the information, our legal obligations, vendor settings, and operational needs.

You may request deletion of certain information by contacting us, but we may retain information where permitted or required by law.

11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information.

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the absolute security of any information.

You are responsible for maintaining the confidentiality of your account login credentials and for notifying us promptly if you believe your account has been compromised.

12. Your Choices

Depending on your location, applicable law, and the nature of your relationship with us, you may have certain rights or choices regarding your personal information, including the ability to:

  • request access to personal information we maintain about you;
  • request correction of inaccurate information;
  • request deletion of certain information;
  • opt out of marketing emails;
  • adjust cookie preferences where a cookie banner or preference tool is made available;
  • request information about our privacy practices.

To make a request, contact us at bmwebsite@briteminds.com. We may need to verify your identity before responding. We may deny or limit a request where permitted by law, including where we cannot verify the request, where the information is needed to provide the Services, maintain records, complete transactions, prevent fraud, comply with legal obligations, or protect rights and safety.

Parents and legal guardians may revoke consent for a teen’s participation by contacting BriteMinds at bmwebsite@briteminds.com. After receiving a verified request, we may restrict the teen’s access, close the account, or delete information associated with the teen or child, subject to legal, security, billing, recordkeeping, and service-related requirements.

You can unsubscribe from marketing emails by following the unsubscribe instructions in the email. We may still send transactional or service-related messages.

13. California and State Privacy Information

BriteMinds does not currently believe it is a “business” subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act. This means that, at this time, BriteMinds does not provide the full set of CCPA-specific rights, notices, metrics, or opt-out mechanisms that apply to covered businesses.

This conclusion is based on BriteMinds’ current understanding of its revenue, California consumer volume, data practices, and use of third-party tools. If those facts change, or if BriteMinds determines that it has become subject to the CCPA or another comprehensive state privacy law, we will update this Privacy Policy and provide any required notices, rights-request methods, and opt-out mechanisms.

BriteMinds does not sell personal information for money. BriteMinds also does not intentionally use quiz answers, assessment results, risk levels, report categories, written reports, child-related information, or chatbot transcripts for cross-context behavioral advertising, retargeting, or advertising optimization.

If BriteMinds later uses cookies, pixels, analytics, advertising tools, or similar technologies in a way that is considered a sale, sharing, targeted advertising, or similar regulated disclosure under applicable law, BriteMinds will update its notices and provide any required opt-out choices.

Even where a specific privacy law does not apply, BriteMinds may, in its discretion or where otherwise required, consider requests to access, correct, or delete personal information. Requests can be submitted to bmwebsite@briteminds.com.

14. Do Not Track and Global Privacy Control

Some browsers offer “Do Not Track” signals. There is no uniform industry standard for responding to these signals, and we do not currently respond to “Do Not Track” signals.

Some browsers and browser extensions allow users to send Global Privacy Control or similar opt-out preference signals. Because BriteMinds does not currently believe it is subject to the CCPA, BriteMinds does not currently process Global Privacy Control signals as statutory CCPA opt-out requests. To the extent our cookie banner or consent-management tool recognizes such signals, those signals may be used to help apply available cookie preferences. If BriteMinds becomes subject to a law requiring recognition of opt-out preference signals, we will update our practices and this Privacy Policy as appropriate.

15. Third-Party Websites and Services

The Services may contain links to third-party websites, applications, platforms, payment processors, scheduling tools, video conferencing tools, or other services.

We are not responsible for the privacy practices, security, or content of third-party services. Your use of third-party services is governed by their own privacy policies and terms.

16. International Users

The Services are intended for users located in the United States. If you access the Services from outside the United States, you understand that your information may be collected, processed, and stored in the United States, where privacy laws may differ from those in your location.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated Privacy Policy will be posted on the website with a revised effective date.

Your continued use of the Services after the updated Privacy Policy is posted means you acknowledge the updated Privacy Policy.
